OKI and GDPR


In April 2016, the European Commission adopted legislation which would extend the scope of the prior, two-decade old data protection rule. This legislation is known as the General Data Protection Regulation (“GDPR”). Its aim is to empower EU individuals’ rights to data privacy. This regulation comes into effect on the 25th of May, 2018 and will apply to businesses processing any personal data belonging to a European citizen, imposing fines of up to €20,000,000 (or 4% of global annual turnover) for non-compliance. This European Law will be implemented into UK law, and will stay binding after the United Kingdom leaves the European Union as Parliament is currently deciding on a suitable revision of the Data Protection Act 1998, expected to become national law next year.

The GDPR emphasises a lawful, in and transparent manner of processing personal data (information defined as anything which could be used to identify an individual person) and aims at harmonising data protection laws across Europe. This legislation is required due to technological penetration and advances in society; the smartphone is a good example of both of these points. We now have machines which we take everywhere and are capable of being utilised by businesses to profile one’s interests, habits and feelings. All in the pursuit for better marketing applicability.
